The Hon’ble Chief Justice of Pakistan Mr. Justice Iftikhar Muhammad Chaudhry took notice on an office note initiated by the Registrar, Supreme Court of Pakistan based on previous judicial orders of this court in Constitution No. 77 of 2010 (Balochistan Law & Order Case) and details of tragic incidents of powerful explosions occurred in Quetta one at Bacha Khan and other one on Alamdar Road on 10.01.2013 causing carnage and resulting in the death of more than 93 persons with 120 injured. The incident caused a furor amongst Hazara Shia Community not just in Quetta but across the country. The situation became critical and ultimately Governor Rule was imposed in Province of Balochistan on 14.01.2013 which is still continuing. Further the press clippings of different newspapers dated 17 & 18.02.2013 carrying the details of tragic incident Hazara Town Quetta on 16.02.2013 leaving 87 citizens dead and two hundreds injured and the statements of different religious and political leaders criticizing the performance of police and other law and enforcement agencies in curbing terrorism in province.
The note further said that the protest of Hazara community continues in Quetta and Shia community all over the country. This is indeed a critical moment in the history of the country. The death of above 87 innocent citizens and injury to 200 others, in bomb blasts is a dismal failure of the Government to provide safety/security to the people and their property, which infringe the constitutional safeguards laid down in Article 4, 9, 14, 24 and 25 of the Constitution.
Taking the notice of the incident the Hon’ble Chief Justice of Pakistan Mr. Justice Iftikhar Muhammad Chaudhry passed the following order:-
“The matter be fixed in the Court on 19.2.2013. Notices be issued to the Advocate General, Balochistan and the Attorney General for Pakistan”.
It is pertinent to mention here that the original case i.e. Constitution Petition 77 of 2010 (Balochistan law and order case) is fixed on 06.03.2013 but the matter regarding above incidents has been fixed for hearing on 19.02.2013. |
