SC DISMISSES OF THE CONSTITUTION PETITION NO. 29 OF 2013

A three member bench headed by Hon’ble Mr. Justice Iftikhar Muhammad Chaudhry, Chief Justice of Pakistan and comprising on Hon’ble Mr. Justice Ijaz Ahmed Chaudhry and Hon’ble Mr. Justice Gulzar Ahmed heard the Const. P. No. 29/2013 filed by Abrar-ul-Haq son of Muhammad Shafi against the Election Commission of Pakistan. The Constitution Petition was filed under Article 184 (3) of the Constitution challenging massive rigging in the Constituency of NA-117, Narowal-III. The petitioner appeared in person and the case was heard on 23-05-2013.

Iftikhar Muhammad Chaudhry, CJ: This petition has been filed under Article 184 (3) of the Constitution of Islamic Republic of Pakistan, 1973, wherein the alleged massive rigging in the Constituency of NA-117, Narowal-III, has been challenged.  

2.                                          We have pointed out to the petitioner that such jurisdiction of the Court under Article 184 (3) of the Constitution, is not available because in such like cases the Constitution has created a bar under Article 225 of the Constitution and if the petitioner, who has contested the election, which may have caused grievance to him, remedy has been prescribed under the Constitutional Provisions. Therefore, this constitution petition is dismissed.
