In pursuance of the letter received from Secretary M/o Law, Justice and Human Rights, Islamabad, addressed to Registrar, Supreme Court, stating that the Federal Government have decided to invoke the powers vested in it under Section 4 of the Criminal Law Amendment (Special Courts) Act, 1976 to establish a Special Court to try General (R) Pervez Musharraf under Section 2 of the High Treason (Punishment) Act, 1973. It further states that the Special Court has to be comprised of three serving judges of High Court, whereas there are five High Courts in the country, therefore, it will be appropriate that the apex Court may nominate any three judges of High Courts for constitution of the Special Court . The Hon’ble Chief Justice of Pakistan has been requested to nominate three judges of High Courts for the constitution of Special Court and one amongst them be designated as its President. The Special Court will function at Islamabad .
After going through the contents of the letter, the Hon’ble Chief Justice of Pakistan has passed the following order:-
“Copy of the letter be circulated amongst the learned Chief Justices of all High Courts viz High Court of Balochistan, high Court of Sindh, Lahore High Court, Peshawar High Court and Islamabad High Court so that they may each nominate a judge of their respective Court, out of which three names shall be forwarded to the Government for the Special Court. The nomination may reach this Court on 19.11.2013 positively.”
