Welcoming the delegation, the Hon’ble Chief Justice of Pakistan said that it is a matter of pleasure for him to receive the respected Cabinet members of the apex body of lawyers of Pakistan. He stated that the bench and the bar are two wheels of the chariot of justice. It is the duty of the bench to dispense justice in accordance with the Constitution and the law while it is the duty of the bar to assist the bench in the attainment of said objective. As a matter of fact, the goal of dispensation of justice cannot be achieved without cooperation and whole hearted support of the members of the bar.
The members of the Supreme Court Bar Association thanked the Hon’ble Chief Justice for providing them an opportunity to bring to his notice the problems being faced by the lawyers in matters, such as fixation of cases, adjustment of dates of hearing, etc. All those issues were discussed at some length and following decisions were made:-
(i) Proposed cause list will be prepared and issued one month in advance so that the learned lawyers and litigant parties may seek adjustment of dates as per their convenience. Thereafter final cause list will be issued on weekly basis and adjournment will not be granted except in exceptional cases. The Supreme Court Bar Association will make an effort to pursue the lawyers to refrain from seeking unnecessary adjournments and facilitate the Court in the prompt disposal of cases.
(ii) A large number of juvenile cases are pending in different courts on account of pendency of case in the Supreme Court wherein vires of the Juvenile Justice System Ordinance have been challenged. The said case will be fixed at the earliest.
(iii) The cases involving financial/commercial disputes will be fixed on priority basis.
(iv) Miscellaneous appeals against the order of Registrar, Supreme Court will be fixed regularly and more promptly.
At the end, the Hon’ble Chief Justice of Pakistan thanked the office bearers of the Supreme Court Bar Association for the courtesy call and added that in his views all the courts, be it the court of Civil Judge, or the Supreme Court, deserve same respect and honour. It is, therefore, incumbent upon the members of the bar to uphold the sanctity and dignity of the courts by all means. The Supreme Court Bar Association being the apex body should play a leading role in advancing the cause of justice and ensuring respect for the dignity and sanctity of the courts.
The Bar members thanked the Hon’ble Chief of Pakistan for sparing time and listening to their grievances patiently. They assured him of their full support and cooperation in achieving the common objective of dispensation of justice.
