On Thursday, 26.03.2015, a three member bench of the Supreme Court of Pakistan headed by Hon’ble Mr. Justice Jawwad S. Khawaja and comprising two other Hon’ble Judges i.e Mr. Justice Ejaz Afzal Khan and Mr. Justice Maqbool Baqar, heard CMA No. 592-K/2013 in SMC No. 16 of 2011 etc, the case regarding purchase of Armed Personnel Carriers (APCs) at an exorbitant rate without adhering to the codal formalities. Previously in its order dated 12.03.2015 while declaring the agreement, for purchase of APCs by Sindh Police, as null and void Supreme Court had interalia observed that Mr. Irfan Qadir, ASC representing the Sindh Police, was required interalia to submit an explanation as to how without instructions or vakalatnama of an AOR, he had been appearing in this case. On 26.03.2015 instead of submitting his explanation, he launched into a harangue and tirade which had been recorded and placed on record. It was also observed by the Court that his conduct in the cases of Ch. Muhammad Ashraf Gujjar vs. Riaz Hussain (2013 SCMR 161), Bank of Punjab vs. Haris Steel Industries (PLD 2010 SC 1109), Arslan Iftikhar vs. Riaz Hussain (PLD 2012 SC 903) and Hamid Mir vs. Federation of Pakistan (Const. P. 105/2012) etc show that he had made it a habit to indulge in misconduct or conduct unbecoming of an Advocate.


His loud, unbecoming tone, and the persistent objectionable conduct compelled the Court to suspend his practicing license as Advocate of the Supreme Court of Pakistan (in order to maintain the honour of Bench and the Bar) and a show cause notice was also issued to him as to why he should not be removed from practice. It was further observed by the Court that persistent acts on the part of Mr. Irfan Qadir displayed a pattern and mindset which was not at all conducive to the honour and dignity of the Court and the Bar. Inspector General of Police, Sindh was also directed to show justification about engaging the private counsel and paying huge professional fee (20 lacs have already been paid to Mr. Irfan Qadir out of 30 lacs) instead of defending through the office of the Advocate General Sindh. This issue will be taken up in 2nd week of April, 2015.
